Abstract:
I will explore the process through which the courts are being used to address climate adaptation and mitigation. Examples of strategic litigation, public and private, will be presented. I will also consider the complexities of using strategic litigation as an engine of social change beyond the courtroom, and highlight key similarities and differences between the climate litigation movement and other strategic litigation movements. There will also be a discussion on whether strategic climate litigation provides avenues for promoting domestic institutional change and to what an extent it is becoming an integral component of climate change governance.
About the Lecturer
Joana Setzer is a British Academy Post-doctoral Fellow, based at the Grantham Research Institute on Climate Change and the Environment, at the London School of Economics and Political Science (LSE). In this current research project, Joana is investigating developments in climate legislation and litigation. Joana’s background is in law, and she holds a PhD in environment and development, a Masters in environmental policy (both from the LSE), and a Masters in environmental science (from the University of Sao Paulo). Joana has worked as an environmental lawyer in Brazil and as the external affairs coordinator of the Network of Regional Governments for Sustainable Development (nrg4SD).
